A true litigator, Daniel handles complex litigation, injunctions, arbitrations and regulatory and white-collar investigations for clients active in a variety of industries.

He often acts for national and international corporations, as well as financial institutions, dealers and brokers (registrants).

He has significant experience in intellectual property litigation, primarily with respect to trade-marks, copy-rights and trade secrets.

Daniel also acts for a variety of indigenous clients, asserting claims related to ancestral rights, land rights, and business disputes.

Daniel appears regularly before the Court of Appeal of Québec, the Superior Court of Québec, the Federal Court of Appeal and the Federal Court.

Daniel sits on BLG’s National Conflict Committee and its Pro Bono Committee.

He is fluent in English and French.

Experience

  • Lead litigation counsel for the most advanced ancestral rights claim in Québec, asserting rights on behalf of the Conseil des Atimakekw Opiticiwan over the Gouin Reservoir.
  • Successfully obtained the seizure of a $1.6M supercar, along with several luxury cars in proceedings before the Québec Superior Court and the Federal Court of Canada.
  • Successfully defended Aimia Inc. and Kognitiv Corporation in injunctive proceedings brought by Air Canada and Aeroplan Inc., thereby ensuring the completion of a $534M transaction for the Intelligent Shopper Solutions and Air Miles Middle East loyalty programs.
  • On behalf of Adobe Systems Inc., successfully obtained a series of injunctions and seizure orders to shut down a network of companies illicitly reselling software.
  • Successfully obtained an Anton Piller order to recover confidential information stolen via industrial espionage.
  • Successfully opposed a number of trade-mark applications which were held to be confusing with the SECRET family of trade-marks (Cortefiel S.A. v. Gildan Apparel (Canada) LP, 2014 FCA 255; Eclectic Edge Inc v. Gildan Apparel (Canada) LP, 2015 FC 1332)
  • Counsel for the Right Honourable Brian Mulroney before the Oliphant Commission
